Five years later, what has been the decision’s lasting impact on nonprofit advocacy, donor privacy, and First Amendment freedoms? How have courts, lawmakers, and regulators responded? AFPF v. Bonta reaffirmed a fundamental principle of a free society: Individuals should be able to support causes they believe in without fear that their personal information will be exposed to the public or government officials. In striking down California’s dragnet of nonprofit donor lists, the Court recognized that compelled disclosure chills speech and association by exposing supporters to the risk of harassment or intimidation.

Since the decision, however, efforts to chill advocacy by exposing nonprofit donor and member lists have continued and arguably even increased. From state officials’ growing use of the subpoena power to target donors to disfavored groups, to ballot measures purporting to regulate campaign finance that secretly restrict issue speech, to constitutionally dubious schemes censoring “out-of-state” or “corporate” entities, nonprofit advocacy and donor privacy remain at the forefront of debates about free speech and civic participation.
